Kasong korapsyon isinampa laban sa opisyales ng Malay dahil sa Boracay pontoon

ILOILO CITY–Lalo pang tumindi ang kontrobersiya tungkol sa pontoon o Floating walkway sa Boracay.

Sa katunayan, sinampahan ng reklamong graft and corruption, abuse of authority, at gross negligence ngayong araw sa Office of the Ombudsman-Visayas ang mga opisyales ng Malay.

Hinihiling ng nasabing kaso ang agarang pagsususpinde kay Malay Acting Mayor Frolibar Bautista at Acting Vice Mayor Niño Carlos Cawaling. Dawit din sa reklamo ang lahat ng miyembro ng Sangguniang Bayan na sina Daligdig Sumdad, Lloyd Maming, Danilo Delos Santos, Maylynn Graf, Nickie Cahilig, Dante Pagsuguiron, Junthir Flores, Ralf Tolosa, at Christine Hope Pagsuguiron.

Matatandaan na noong Disyembre 21 ng nakaraang taon, nagsimulang maningil ang munisipyo ng Malay ng Php 30 sa bawat tao na gagamit ng pontoon na matatagpuan sa Stations 1 at 3. Sinimulan ang paniningil
matapos ibaba ni Bautista ang Executive Order No. 51 series of 2019 nag-oobliga sa lahat ng water sports at sea sports operators na gumamit ng nasabing mga pontoon sa kanilang mga sports activities.

Nakasaad sa nasabing reklamo na ma-anomalya umano ang pangongolekta ng user’s fee ng walang ordinansa.

“Beyond doubt, the fact that the collection of said user’s fee was implemented without the requisite of an Ordinance is highly anomalous. The law is very clear in Section 132 of the Local Government Code that the power to impose a tax, fee, or charge or to generate revenue shall be exercised only by the Sanggunian of the local government unit concerned through an appropriate Ordinance,” nakasaad sa reklamo.

Ang nagsumite mg reklamo, ang boracay-based journalist na si Noel Cabobos na s’yang editor ng Boracay Informer, ay nagsabing dapat ding papanagutin ang lahat ng myembro ng konseho ng Malay sapagkat maliban sa kawalan ng ordinansa, ang hindi nila pagharang sa EO ay isang malinaw na gross negligence at paglabag sa Section 3 ng Anti-Graft and Corrupt Practices Act.

“We are governed by laws not of men. They cannot just impose fees as simple as that. The bad faith and manifest intent of the respondents to cause the public wrong for their personal gain is very evident from the systematic and orchestrated issuance of an Executive Order to collect such fees,” pagpapaliwànag ni Cabobos.

“Yes, I agree that the mayor has the authority to issue executive orders within his executive and administrative powers since EOs are official directives or commands from the local chief executive to agencies in the executive branch. Meaning, these orders generally concern the implementation or enforcement of rules, policies and procedures which have the force of law, but let me emphasize here that Mayor Bautista’s exercise of his executive and administrative powers cannot impinge on the legislative powers of the Municipal Council, therefore, as the local chief executive, he may not usurp the legislative function by enacting policies not adopted by the legislative branch,” giit pa niya.

Tinuligsa din ni Cabobos ang utos ng alkalde sa mga watersports and seasports operators na kailangan nilang pumasok sa isang kontrata kasama ang isang pribadong travel company na siyang namamahala ng mga pontoon.

Dagdag pa rito, inatasan sila diumano ni Bautista na mangolekta ng mga user’s fee kahit walang resibo.

“Again, this is a clear violation of the law since Section 130 paragraph (c) of the Local Government Code succinctly provides that the collection of local taxes, fees, charges and other impositions shall in no case be let to any private person,” aniya.

Kamakaylan lang, ang Boracay Water Sports Association (BWSA), na isa sa apat (4) na
grupo na inutusan ni Bautista na magkolekta ng bayarin, ay nagtangkang pigilan ang pagpapatupad ng EO sa pamamagitan ng Board resolution nito ngunit bigo sila na mapatigil ang implementasyon.

Noong Sabado, sinulatan na rin ni Boracay Inter-Agency Rehabilitation Management Group (BIARMG) general manager Natividad Bernardino si Bautista na dapat ipatigil ang isinasagawa nilang paniningil dahil umano sa mga reklamo na natatanggap niya mula sa iba’t ibang stakeholders, sports enthusiasts, at turista sa isla.

Ang BIARMG ang implementing arm ng Boracay Inter-Agency Task Force (BIATF)
na pinamumunuan ni DENR Secretary Roy Cimatu.

Inatasan ang BIATF, sa pamamagitan ng Executive Order No. 53 ni Pangulong Rodrigo Duterte, na bumuo at magpatupad ng mga plano at aksyon kaugnay sa rehabilitasyon ng Boracay.
